How long do I have to file an injury claim in East Baton Rouge, LA?

Most Louisiana personal injury claims now carry a two-year prescriptive period for accidents occurring on or after July 1, 2024, and one year for earlier accidents. Evidence disappears quickly, so call as soon as you can.

How much is my case worth?
There’s no standard answer – it depends on your injuries, medical bills, lost wages, and how liability plays out. A minor fender-bender is worth far less than a serious I-10 collision with permanent nerve damage. In East Baton Rouge, we’ve settled cases anywhere from $15,000 to over $2 million. The difference usually comes down to: How badly were you hurt? How clear is the other person’s fault? What did your medical treatment cost? Will you have ongoing expenses? The fastest way to get a real estimate is a consultation. We’ll review your accident report, medical records, and insurance details – then give you a realistic range based on similar cases we’ve handled locally. Most personal injury consultations are free; we only make money if you do. Call us at (225) 443-4522 with the details, or fill out the form above and we’ll reach out within one business day.
What if I was partially at fault in a car accident - can I still recover damages?

Yes. Louisiana uses comparative negligence, which means you can recover damages even if you share some of the blame.

Here’s how it works: If you’re found 30% at fault and the other driver is 70% at fault, you can recover 70% of your total damages. So if your case is worth $100,000, you’d get $70,000. Your recovery is reduced by your percentage of fault – nothing more.

This is generous compared to some states. In places like Virginia or Maryland, if you’re found more than 50% at fault, you recover nothing. Louisiana doesn’t have that cutoff. You can be 60% at fault and still recover 40% of damages.

The catch: The other side will argue you were more at fault than you think. An insurance adjuster might claim you were tailgating or distracted, trying to lower what they owe. That’s where evidence matters – police reports, witness statements, dashcam footage, traffic camera recordings. We dig into those details to fight inflated blame.

Most accidents aren’t black-and-white. Even if you made a mistake, that doesn’t bar your claim – it just affects how much you recover. We’ll be honest about your exposure and build the strongest case with the facts we have.

Can we settle this without going to court?

Most cases do settle without trial. Insurance companies and opposing parties often prefer settlement to the cost and uncertainty of court. We start by negotiating—presenting your damages, liability evidence, and medical records to push for a fair number.

If they offer enough and the terms make sense, you settle. We handle all the paperwork; you get paid, and the case closes.

When court becomes necessary: If the other side won’t budge or their offer is insulting, we’re ready to file a lawsuit and take it to trial. Sometimes the threat of court is what gets a reasonable settlement on the table. Other times, they’re betting on a jury ruling in their favor, so negotiation stalls.

The reality: Trials are expensive, take months or years, and the outcome is never guaranteed—even with a strong case. Most people and insurance companies know this, which is why 90% of personal injury cases settle. Our job is to build such a strong case that settlement makes sense for everyone.
